WifiDB User Agreement

This User Agreement ("Agreement") between you and TechIdiots LLC ("Company," "we," "us," or "our") sets out the terms and conditions that govern your use of wifidb.net and related services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree, you may not access or use the Services.
1. Your Access to the Services
No one under 13 years of age is allowed to use or access the Services. We may offer additional Services that require you to be older to use them, so please read all notices and terms carefully.
By using the Services, you state that:
- You are at least 13 years of age;
- You have the legal capacity to enter into a binding agreement with us;
- You are not barred from using the Services under applicable law; and
- You have not been permanently suspended or removed from the Services.
2. Your Account
To use certain features of our Services, you may need to create an account. You agree to:
- Provide accurate and complete information;
- Keep your account secure and not share your password;
- Accept responsibility for all activities that occur under your account;
- Notify us immediately if you believe your account has been compromised.
You will not license, sell, or transfer your account without our prior written approval.
3. Your Use of the Services
Subject to your complete and ongoing compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Access and use the Services for your personal, non-commercial use; and
- Access and view content created by other users.
We reserve the right to modify, suspend, or discontinue the Services at any time, with or without notice.
4. Your Content
4.1 Content Ownership
You retain ownership of any content you submit, post, or display on the Services ("Your Content"). By posting Your Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works from, distribute, store, perform, and display Your Content in connection with the Services.
4.2 Content License
This license includes the right to:
- Display your content across the Services;
- Format your content for accessibility on different devices;
- Provide your content to partners who distribute content for viewing;
- Analyze and make changes to the Services based on user content.
4.3 User-Generated Content Responsibility
You are solely responsible for Your Content. You represent and warrant that:
- You own or have the necessary rights to post Your Content;
- Your Content does not infringe any third party's intellectual property rights;
- Your Content is accurate (if you state facts) and not misleading.
4.4 Passive Data Collection Exception
We acknowledge that wireless network names (SSIDs) observed during scanning are created by third parties. Data uploaded that contains offensive or prohibited language solely within the observed network details (SSID/BSSID) will not be considered a violation of this Agreement, provided you did not create the offensive network name yourself.
5. Third-Party Content and Services
The Services may contain links to third-party websites, products, or services. We do not control or endorse these third-party services and are not responsible for their content or practices.
6. Moderators
6.1 Volunteer Status
Forums may have moderators who are volunteers. Moderators are not employees, contractors, or agents of the Company. We reserve the right to revoke moderator permissions at any time.
6.2 Moderator Responsibilities
Moderators agree to:
- Follow the Content Policy and Moderator Guidelines;
- Act in good faith when moderating their communities;
- Respect the Community Guidelines when enforcing forum rules;
- Not take actions solely to benefit themselves financially.
6.3 Liability
Moderators are not authorized to act on behalf of the Company, and the Company is not liable for actions taken by moderators.
7. Prohibited Conduct
You may not:
- Use the Services for any illegal purpose;
- Harass, threaten, or intimidate other users;
- Post content that is obscene, defamatory, or infringes intellectual property rights;
- Impersonate any person or entity;
- Attempt to gain unauthorized access to the Services;
- Interfere with the proper working of the Services;
- Circumvent any measures designed to prevent or restrict access;
- Use bots, scripts, or automated tools (except as specifically permitted);
- Create multiple accounts to evade bans or manipulate features;
- Scrape, crawl, or use automated means to access or collect data from the Services without our express written permission;
- Use any data obtained from the Services to train, develop, or improve any artificial intelligence, machine learning model, or similar technology, whether for commercial or non-commercial purposes;
- Access the Services in violation of our robots.txt file or other technical measures designed to restrict automated access.
8. Intellectual Property
8.1 Our Content
The Services contain content owned by the Company ("Our Content"), including but not limited to text, graphics, logos, and software. Our Content is protected by copyright, trademark, and other laws.
8.2 Unauthorized Data Collection and AI Training
Without limiting the foregoing, you expressly agree that:
- No Scraping: You will not use any robot, spider, scraper, crawler, or other automated means to access the Services for any purpose, including monitoring, copying, or extracting content;
- No AI Training: You will not use content from the Services, including user-generated content, to train, develop, fine-tune, or improve any artificial intelligence system, machine learning model, large language model (LLM), neural network, or similar technology;
- No Data Harvesting: You will not systematically collect, aggregate, or compile data from the Services to create databases, datasets, or data products;
- robots.txt Compliance: You agree to respect our robots.txt file and any meta tags or headers that restrict automated access;
- API Terms: If we provide an API, any access must comply with our separate API Terms of Service, and API access does not grant rights to use content for AI training.
Exceptions: The restrictions on automated access in this Section do not apply to:
- Public search engines accessing the Services solely for the purpose of creating publicly available searchable indices, provided they comply with our
robots.txt; - Authorized third-party service providers (e.g., Google AdSense, Google Analytics) operating on behalf of the Company;
- Internal operations conducted by the Company;
- Any other connections or access explicitly authorized by the Company.
Violation of these provisions may result in immediate termination of access, legal action, and liability for damages including statutory damages where applicable.
8.3 Trademarks
"WifiDB," "Vistumbler WiFiDB," the WifiDB logo, and other names and logos associated with the Services are trademarks or service marks of TechIdiots LLC. You may not use these marks in a way that suggests endorsement by, or affiliation with, the Company without our written permission.
9. Termination
9.1 Termination by the Company
We may suspend or terminate your access to the Services at any time, for any reason, including violation of this Agreement. Upon termination:
- Your license to use the Services is revoked;
- We may delete your account and content;
- Provisions that by their nature should survive will remain in effect.
9.2 User-Initiated Account Deletion
Account deletion is not currently available as a self-service feature. To request deletion of your account, please contact us at info@techidiots.net. Registered users may delete their own uploads through their account dashboard. Upon account deletion, your account information will be removed; however, WiFi data you uploaded may remain in the public database as part of our historical records.
10. Disclaimers and Limitation of Liability
10.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
11. Indemnification
You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the Services;
- Your Content;
- Your violation of this Agreement;
- Your violation of any third-party rights.
12. Section 230 Notice
The Company is a provider of an interactive computer service. In accordance with 47 U.S.C. § 230, the Company is not the publisher or speaker of any content provided by users. We are not liable for content posted by third parties.
13. Governing Law
This Agreement shall be governed by the laws of the State of Massachusetts, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Changes to This Agreement
We may update this Agreement from time to time. If we make material changes, we will notify you by posting the revised Agreement on the Services with an updated effective date. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Agreement.
16. General Terms
- Entire Agreement: This Agreement constitutes the entire agreement between you and the Company.
- Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
- Waiver: Our failure to enforce any right or provision does not waive future enforcement.
- Assignment: We may assign this Agreement without restriction; you may not assign without our consent.
